California Labor Code 4850: Full Salary Benefits for Injured Public Safety Workers

One of the most important is California Labor Code Section 4850.

What does the term “Labor Code Section 4850” mean?

Labor Code Section 4850 provides for full salary pay for certain public safety workers who suffer a job-related injury or illness, allowing them to receive their full salary for up to one year while recovering from their injury or illness.

Typically, injured workers receive approximately 2/3 of their normal pay through temporary disability benefits. According to Section 4850, eligible workers will receive 100% of their normal salary (for up to 12 months), and these benefits will replace temporary disability benefits during that time; therefore, you will not have to use your accrued sick or vacation leave.

Which Public Safety Employees Are Eligible For Section 4850 Benefits?

Not all workers are eligible to receive benefits under Section 4850. The majority of workers eligible for Section 4850 benefits are full-time public safety employees which includes:

  • Police Officers
  • Firefighters
  • County Sheriffs & Deputies
  • City & County Peace Officers
  • California Highway Patrol Officers
  • Government Agency Employed Lifeguards

You will qualify for Section 4850 benefits if you meet each of the following requirements:

  • You are employed full time in an eligible position.
  • You suffered a job related injury or became ill due to job performance.
  • You are currently unable to perform your job duties at the time of the injury.

Benefits of Section 4850

Section 4850 provides for 100% Salary Replacement While Recovering From A Job Related Injury

The main advantage of Section 4850 is that you’ll receive your normal salary for up to 12 months while you’re recovering from your injury, rather than reduced temporary disability payments. As such, Section 4850 provides you with a high level of financial security and stability throughout the recovery process.

No Use of Sick Leave or Vacation Leave

Generally, while receiving 4850 benefits, you won’t need to utilize your accrued sick leave or vacation time. Your salary will remain the same as though you continued to work.

Transition to Temporary Disability After Section 4850 Benefits End

Once the one year maximum has been reached, you may then apply for temporary disability benefits if you’re still unable to work. At that time, temporary disability payments will generally pay you approximately 2/3 of your normal wages.

Are All Work Related Injuries Covered By Section 4850?

Section 4850 only covers injuries and illnesses directly related to your employment. These may include:

  • Injuries sustained in accidents or physical exertion
  • Illnesses contracted from exposure
  • Hearing Loss
  • Respiratory Conditions
  • Repetitive Stress Injuries
  • Traumatic Disorders

If the injury or illness is related to your work, you should qualify, however, medical proof of this relationship will likely be required.

Important Limitations of Section 4850 Benefits

There are some restrictions and limitations of Section 4850 benefits:

  • Maximum One Year of Full Salary Benefits
  • Eligibility for full salary benefits is limited to a total of one year. If you return to work and are injured again, this limitation will not be extended
  • Proof of work-related medical condition required
  • You will need to provide medical reports to prove
  • That the injury or illness is job-related
  • That you are temporarily disabled
  • That you are unable to perform your job duties

It’s generally necessary to obtain ongoing medical evaluations and keep current with reports to ensure compliance with the medical proof requirements.

Only Applies to Certain Jobs.

Not all government or public service employees are entitled to Section 4850 benefits. Many clerical employees, office personnel and other public employees are not eligible for this section of the Labor Code.

How Section 4850 Benefits Interact with Other Benefits Available to Public Safety Employees

Public safety employees may be able to collect several types of benefits after being seriously injured.

Temporary Disability

After 4850 benefits expire, you may be eligible for temporary disability if you are still unable to work.

Permanent Disability

If your injury results in long-lasting limitations, you may be eligible for permanent disability benefits. Permanent disability benefits are separate from Section 4850 benefits.

Disability Retirement or Pension Benefits

Depending upon the type of employment, some employees may be eligible for disability retirement or pension benefits if they are permanently unable to return to active duty. These benefits may run concurrently with workers’ compensation benefits.

How to Apply for Section 4850 Benefits.

To receive Section 4850 benefits, you must go through the standard workers’ compensation application process.

Step 1: Report the Injury.

Inform your employer immediately. In general, you must report a workplace injury to your employer within thirty (30) days.

Step 2: Obtain Medical Treatment.

Visit a doctor who is authorized to treat work related injuries and follow their recommendations. It is recommended that you maintain copies of all of your medical records.

Step 3: File a Worker’s Compensation Claim.

Submit a completed DWC-1 claim form to formally initiate your claim and allow benefits to commence.

Step 4: Follow Up On Your Benefits.

Ensure that your employer and workers’ compensation carrier are providing you with 100% salary benefits under Section 4850. Errors and delays occur frequently.
